3:07
one o two five. If you've got a question about divorce, anything in
3:10
that or universe, Rick Jones is going to have the answer for you.
3:15
Our first caller is Mark in Seattle. Hey, Mark, Hey, Hey,
3:20
what's going on? Rick? How you doing? I had a question I thought I heard you say recently that it's unlikely for a father and a
3:24
divorce to be granted fifty to fifty custody of young children. My wife works
3:30
more ours than I do. We have two kids age three or five.
3:35
Is there a chance of me giving custody based on that, or is fifty
3:38
to fifty a chance where she is going to stay at home? Yeah? I mean sure, certainly there's a chance. When you heard me before talking
3:44
about young children, we were probably talking about infants and maybe even short of
3:49
that, you know, toddlers, things that are you know, kids that
3:52
are a little bit more I guess, reliant on the physical side of motherhood. So with the ages of your kids and the fact that you're telling me
3:59
that she your work schedule is actually more onerous than yours, it tells the
4:03
world that you're already performing some of these parenting functions that the courts look at
4:09
and value very highly. So what you certainly want to do is to start
4:13
writing things down. In other words, prepare yourself for information you're going to
4:16
give to an attorney about what your day to day is. Obviously, you
4:20
feed the kids, do you get them bathed, You get them off to
4:24
whatever obligations they might have, if it's preschool or otherwise. So those are
4:28
the types of things that people are looking at when they're trying to make a decision about what's in the best interests of your children. Well, good luck,
4:33
Mark, that sounds like we are starting off with some good news.
4:36
Love it all right? Great, thank you. If you've got a question
4:41
for Rick Jones, call eight hundred and two five two one two five Right
4:44
now, Rick Jones is here taking your calls basically giving you free legal advice.
4:47
Jason in Bellevue is our next caller on with Rick Jones of Goldbrig Jones.
4:51
Hey, Jason, how can I help you? Hey? Well,
4:55
actually, I'm kind of I'm headed toward divorce right now, and I'm just
4:59
wondering about some of the small things, like I don't know, how do
5:01
you figure out who the kids are going to spend holidays with? That kind
5:03
of thing and stuff that's hammered out verbally? Do you just talk about it
5:09
or is it literally like Christmas and East are in the divorce agreement on paper?
5:15
Sure, well, it can happen either way, to the extent that
5:17
the two of you can just work out by agreement conversationally how this all should
5:23
go down. That's great. Now you still end up manifesting that agreement in
5:26
what's called a parenting plan, which is your rule book, you know,
5:29
like a board game used to have. So you still want to create a parenting plan that lays it out every single year now, even in the absence
5:36
of agreement, though, there's some common practices where you go in with an
5:40
expectation and usually when it comes to holidays, those regardless of the of the
5:45
overall custody split, those are usually split down the middle. For example,
5:48
it may say father has Christmas Eve and Christmas Day every odd year, mother
5:56
every even year, and that'll be actual verbiage in his parenting the parenting plan.
6:00
The goal of a parenting plan is to always have a rule book that answers every single question you could ask in the absence of an agreement. And
6:06
Danny Bartaducci has always said, make sure you get that all in writing,
6:11
because everything can seem amicable in the beginning and it's all like, oh yeah,
6:15
Jason totally can have them for Christmas, and then the following year she's
6:19
like, no, I'm keeping the kids for Christmas. Danny's a wise man.
6:24
Well, Rick Jones is the wise man when it comes to the world
6:26
of divorce. If you've got a question for him, you can call right
6:29
now. Eight hundred and two five two one oh two five. Rick Jones sitting right here taking your calls. We've got an anonymous caller from Renton.
6:35
We've got a John Doe. Hello, John Doe, how are we doing
6:42
today? Terrific? How can I help you? So? I was divorced
6:46
back in two thousand and seven. My wife at the time wanted half of
6:54
my retirement. We started a QDRO but they finished it and it said be
7:00
determined at a later date. Is there a statue of limitations on that?
7:05
No, there's not, because if in your divorce decree it reserved that right
7:11
said TBD. Basically, it meant everybody recognizes that this is an asset that
7:15
yet is to be is yet to be divided. So it really is something
7:19
that she could raise because obviously it's going to be more in her interest to
7:24
raise it. She can actually raise this at any time. What is a
7:27
QDRO. Yeah, we call it QUADRO, but it stands for a qualified
7:30
domestic relations order And it's actually a very valuable tool when somebody has an asset
7:38
like a pension, like an era that you don't want to reach into.
7:43
It allows there to be a transfer in the event of a divorce without it
7:46
being a taxable event. Okay, Now, John Doe says, this all
7:49
went down in two thousand and seven. Is this normal that it's still up
7:53
in the air like this. It's a little bit shocking that she hasn't brought
7:56
this up sooner, all right, But again they may be getting you know,
7:59
the six ten years ago, if they were forty at the time, all of a sudden, you know, fifty six now and now is probably
8:05
the time for her to raise it. And as far as John does concerned,
8:07
no news or no word is good word. There you go, John,
8:11
Do you have any further questions for Rick Jones? Yeah? So I
8:16
was just wondering, So if I do end up retiring and she never does
8:18
this, can she still go back or is it at that point be lost
8:24
out? Sure? Well, I don't see that she's ever lost her her
8:26
ability to go in and seek that. Now. What happens though, is
8:31
it really kind of depends on what sort of a pension that you've got. If it's a lump sum type of item, then you know, obviously she
8:37
can reach into that. If it's something where you're just paid on a month
8:41
to month basis, almost in lieu of salary, well every month that goes
8:45
by. With that in your pocket, she's really not going to be able to reach back and get that. All right, there you go, John
8:50
Doe. I think we're two for two with good, good answers. Right, let's keep this rolling, all right, Kenny isn't Kirkland and you are
8:58
on with Rick Jones of Goldberg Jones Pressure Kenny, I hope not. But
9:03
here's the deal. My kid actually got like really drunk and even stupid or
9:07
down to Vegas and got married to a girl he barely knows, and she
9:13
regrets it. He regrets it. But we don't know what to do now,
9:16
Like I don't know the difference between annulment, divorced, and really is
9:22
there anything else besides those two? Yeah, there is. I'm gonna slip
9:24
something right in the middle. There called a legal separation. I don't know
9:28
if that applies. In fact, I can tell you right now, given
9:31
the circumstance, that shouldn't apply. But an annulment is actually not a legal
9:37
phrase. An annulment is really more church based, where it's you know,
9:41
if your beliefs recognize that phrase, there's the ability to say, hey,
9:48
listen, this really never happened. There is one other possibility. But I'm
9:52
gonna ask you a couple of questions to see if it matters, which is, did they ever live together after they got married? No, they they
10:00
got married help Vegas, Vegas. How long ago was this? This was
10:09
two weeks ago, So we're trying to figure it all out. Yeah.
10:11
Yeah, Actually, you know what, I've actually got more good news to
10:15
give up to give out. There's the ability to go in and seek what's
10:18
called a declaration of invalidity. And again it's fairly rare because if they would
10:22
have come home and shocked up for two months, you know, we'd be
10:26
talking a different story. But yeah, you can see what's called a declaration
10:30
of invalidity, and in a case like this, both of them are going
10:33
to sign off on it, right, it's going to be done by agreement
10:35
through the court system, and it's going to basically say this didn't happen at
10:39
all, It was never valid to begin with, we didn't consecrate the marriage.
10:43
Without obviously getting into too much Vegas detail, but yeah, that's that's
10:48
actually great news, and it's a rare event, so more good news.
10:54
Congratulations Kenny and Kirkland, your son can uh I don't want to say get
10:58
rid of this, but if you've got a question for Rick Jones of Goldburg
11:03
Jones, he is here taking your calls right now eight hundred and two five
11:05
two one two five. Anything to do with family law, divorce, child custody. Rick Jones has taking your call at eight hundred two five two one
11:11
two five. Bob in Seattle is next, Hey, Bob, Bob,
11:18
Yeah, that's you. Hi. Hi. Uh So, I've been paying
11:24
child sport for past thirty years and my kids are all over thirty years old.
11:31
What is the cutoff? I'm I'm stumped only because there must be something
11:39
going on, you know, under the surface. Let me ask you a couple of questions. Were you able to stay current or was there kind of
11:46
a back support obligation that was created way back when? All right, Bob,
11:52
you've got a pretty bad phone connection. Typically from my understanding, Rick
11:56
Jones, when you have been with us for quite a long time, is
12:01
eighteen yeah, eighteen or finishes high school whichever happens latest. Yeah. So
12:07
in other words, somebody could be eighteen and a half, but they graduate
12:09
in June. That's when it ends, and then there's a potential of what's
12:13
called post secondary support, which is college era. But even then an extended
12:18
one is five years, and that's only if somebody is actively pursuing a trade
12:22
or a degree. So the only thing I can assume that's going on in
12:26
Bob's life is there must have been some sort of a back support obligation created
12:31
that a cruise. So let's say your child support obligation is one thousand dollars,
12:35
but all you can pay, or all that they got, so to
12:39
speak, was five hundred dollars a month. Well, then five hundred dollars
12:41
a month adds up as something that needs to ultimately be paid back. Now,
12:46
Bob, if you're listening, if that's not the case, call somebody. I mean call my office, but call somebody, because terminating child support
12:52
should be a no brainer. If you don't have a balance due, yeah
12:56
thirty, they're not kids anymore. Well, you can call it. Jones
13:00
at one eight hundred divorce or online Goldberg Jones dot com. But he isn't
13:03
here right now taking your calls at eight hundred two five two one two five.
13:07
We've got Rich in Snohomish on with Rick Jones. Hey Rich, Hey,
13:13
Rick, Well, so my situation is that my wife and I are
13:18
getting a divorce, but we were married in this country, but she has
13:22
already moved moved back to her native country of England. How do we do
13:28
that? Sure? Is she on board with getting a divorce? Yeah,
13:33
okay, then it should be no problem whatsoever. Washington still has what's called
13:37
jurisdiction, in other words, the power to rule on your marriage. In
13:41
fact, Washington has it far more so than England would, right because you
13:46
didn't go back there with her, so don't they don't have any jurisdiction over
13:50
you. So what you'll want to do is initiate the process, create the
13:54
documents of the final orders, if you can do this by agreement, and
13:56
then you send them off to her. We get her signature. They I'm
14:00
back and you're done in ninety days. Woo more good news. Okay,
14:05
all right, thank you, you're quite welcome. All right. Rick Jones
14:07
of Goldburg Jones doling out some pretty great advice this morning. Well, I
14:11
make it seem like it's not that case every week. Hey, it's Christmas,
14:15
all right, Kelly in Linwood. You are on with Rick Jones of
14:18
Goldburg Jones. Hello, Kelly, good morning, I was divorced back in
14:24
two thousand and ten, I think, and we had agreed that you keep
14:30
your retirement in pension. I keep my retirement intension. And since then he
14:37
has passed away in an accident, and I went and applied for all of
14:43
his tension and retirement got cashed out on all but his Union tension. And
14:48
I'm wondering if that's because they said because of the divorce degree, he doesn't
14:52
get it, or I don't get it. Can I petition for it to
14:56
go to his children? So this is going to get into the specifics of
15:01
what the Union pension really says. But I was actually surprised pleasantly when you
15:07
told me you were able to be successful at having some of his pension come
15:11
your way, some of his retirement benefits come your way, because according to
15:15
the decree it was, he keeps his right. So, like I said,
15:18
I was pleasantly surprised for you to hear that. What I'm guessing happened
15:22
here is that there was some level of survivor benefits that he's able to designate,
15:28
and that survivor benefit designation must have gone towards him. It's very possible
15:35
that the Union pension portion you're talking about didn't allow for any sort of survivor
15:37
benefit because ordinarily, even without any any wording specifically, it would have gone
15:43
to his children, just like you a will when you die, intestate or
15:46
without a will. So Kell, I'd reach out to the union and see
15:52
where it's going to go. Okay, thank you very much, I appreciate
15:56
it. You bet well. We've got an email that has been sitting here
16:00
for a while. I think we need to address. John and Kirkland sent
16:03
an email. My brother in law's having an issue with this divorce. His
16:07
personal income is too high to gain access to low income resources, but he
16:10
can't afford to hire a lawyer because my sister is spending all the money they
16:12
have in their joint account. He is desperately in need of advice. Are
16:17
there any affordable legal services that he can seek out? Boy? You know,
16:23
Unfortunately, like some other areas of law, especially in the criminal side,
16:27
where there's a risk of actually, you know, losing your liberty,
16:32
where there's such a thing as a public defender, there's really not such a thing in family law. It really is a civil lawsuit, a lawsuit like
16:40
any other lawsuit that might happen. He certainly can try making some phone calls.
16:45
Sometimes. Some of the law schools have internship programs where you have a
16:49
third year law student who's admitted to semi practice but under the supervision, so
16:56
he may want to make some phone calls. There. One of the things
16:59
I want to point out, and maybe this isn't for John, but it's
17:02
for other people listening though, is when I hear that he can't afford it
17:06
because his wife is spending all of their money, I'm going to ask a
17:11
question, which is can he afford not to right, because in other words,
17:15
this tire just keeps leaking and leaking and leaking, So he may have
17:18
to just buck up, you know, somehow bar the money, friends,
17:22
family, grandparents, if there's children involved, and we see that actually probably
17:29
in half of the family lack cases we handle, right, money is usually
17:33
not you know, dropping off the trees. When somebody's in the process of
17:37
gaining divorce and I think I've heard you say before that there is something he
17:41
can do to stop her from spending all of their money. Yeah, once
17:45
you file a case, there's basically an automatic temporary restraining order that's put in
17:48
place, and it applies to both of the parties, which is, do
17:52
not spend any money outside of the ordinary course of income. All right,
17:56
there you go. We've got time for one more caller. It is Rick
17:59
Jones from gold Burg Jones and we are putting on with d in Seattle.
18:03
Hello Dean, Hi Darre. Hey, what can I do for you?
18:08
So my question is I was divorced back in twenty fourteen, and I did
18:17
have a Quadroe order. I was unaware of the fact that it was his
18:22
single wife. There was some sketchy stuff in the divorce degree. But anyhow,
18:29
my ex husband passed away in twenty twenty and I tried to go back
18:36
to court to see if that could be revised and to be able to collect
18:40
that. We were married seventeen years and I couldn't get through to an attorney.
18:47
Everything was closed down during COVID. Yes, oh okay, well times
18:55
have changed. Yeah, I mean there's somebody answering our phone. What time
19:00
is it? Yeah, there's divorced d Yeah, we'll be answering the phone
19:03
in about five minutes. So quadra order was in effect. Now she wants
19:08
to make some changes. All she has to do is contact an attorney and
19:11
see if she can move forward with that. Well, it's probably not as
19:15
simple as that. I mean, eventually, a deal is a deal,
19:18
and especially when it was done so many years ago. So to try and
19:21
now seek to change something when the other party in this case obviously isn't able
19:25
to appear because of his passing. So I don't know if there's any avenue
19:30
of benefit, but it's worth making the call and having somebody take a look
19:33
at your documents. All right, d you heard him make the call.
19:36
We've got yea four minutes till Rick Jones's office. So the offices of Goldberg
19:41
Jones open at one eight hundred Divorce. You can always find Rick Jones by
19:44
going to Goldberg Jones dot com as well. That is all the time we
19:47
have for today, but Rick Jones will be here, oh the first Wednesday
19:51
of January. Crazy awesome to have you in here. Thanks as always,
19:55
Rick Jones, thank you, and go Huskies. All right, we have
19:59
got Danny Bonaducci's take next. You know, Danny's got a lot of very
20:03
strong opinions, and he's gonna give us his opinion on eggs. What does
20:07
he think? We will find out what his opinion is after Green Day and
20:10
what ant two point five k's okay? The classic rock station one O two
20:14
point five zy okay a classic rock station. Sure, I saw some red
20:18
flags. The Danny Bonaducci and Sarah Morning Shows weird. He's a nurse us
20:23
Danny Bonaducci's takes that. Here's my take on eggs. I just love eggs.
20:30
They're great. I take them scrambled fried, poach, based in baked,
20:33
hard boiled, soaw ball and now I'm gonna get real fancy. Were
20:36
they ready, Sue VD? Yeah? Side note, the line cooks at
20:40
Denny's are like artists. They always get my eggs just right. And I
20:45
love a good armlet. I like eggs bettered at Keish for Tana Devil's eggs,
20:48
But don't give me too much of those, if I know what I
20:51
mean. Think about it when someone's being called a good guy, and they
20:55
often say he's a good egg when life is good, it's sunny side up,
20:57
and that cracks me up. What I did there when I was a
21:00
kid. Easter egg hunts. We're the bomb. Eggs are the gift that
21:04
keeps on giving. You can eat them, you can hide them, and
21:07
don't forget. You can throw them at people. And that's my take on
21:10
eggs. Why don't two point five kz okay? The classic roxation where we are playing the game Peter Piper picked a chili peppers. This game gives you
21:17
a chance to win a pair of tickets to see the Red Hot Chili Peppers
21:19
May thirty first at the Gorge Amphitheater. To win the tickets before they even
21:23
go on sale, you have to pick the pepper from the clue. Ginger
21:27
in Tacoma is our contestant, and I'm hoping you are a pepper expert.
21:33
Ginger. I I'm not sure if I pull myself an expert, but I'm
21:37
a big chance. Okay, good you ready for your clue? Yes,
21:42
all right, here you go. Peter Piper picked a peck of this pepper.
21:47
It's what makes Jamaican jerk chicken super spicy. Often compared to its cousin,
21:52
the heaveniero pepper because of their similar look. This pepper is fruitier and
21:56
is a staple and Caribbean food. How hot is it? With a heat
22:00
rating of one hundred thousand to three hundred fifty thousand Schoolville units, that's pretty
22:06
damn hot. Can you name the pepper that Peter Piper picked. Oh,
22:11
I want to say jalapeno, but I don't know if that's right. That
22:15
is not right, Ginger. Oh, I'm so sorry. Kalapeno pepper was
22:19
not the answer. Robert is in Renton. Robert, you have the correct
22:23
